They base their judgement and verdict on probability. No court of law could give a guilty verdict purely on probability. Also, if you look into Evra's statement, he says he told the referee that Suarez was being racist. Yet nothing in the referee's match report.

And when the FA released their original statement regarding their verdict, they said that they didn't think Suarez was a racist. But if they're taking Evra's statement as evidence, then he comes across as pretty racist to me.

I imagine Liverpool will take this higher into a court of law. If so, I cannot see how they can sustain a guilty verdict under this evidence.

Most cases are settled using probability along with credibility, demeanour and consistency. It's not purely on probability.
The main evidence used were statements taken from Evra, Suarez, Kuyt and Damien Comolli (plus all the other players who were not needed to give evidence at the hearing and whose statements were taken as fact), the main problem being what phrase was used; both Kuyt and Comolli said that Suarez told them straight after the game in Spanish and in Dutch "Because you're black" when Evra asked why he got kicked, Suarez said he said "why, black?" when Evra said "Don't touch me South American" then changed the chain of events he recalls after seeing the Sky broadcast.

Evra's also said he doesn't think Suarez is a racist, he just said something racist, probably to wind him up.

He's either guilty of saying something racist, or he's fantastically incompetent and his representation were just as bad.
